Class 1 or Class 2?

Trying to decide between 2 bikes for the build, I am thinking of doing this bike

but the seattube has been butchered so I'll have to weld on a top with a clamp, and I'll have to cut off the welded on luggage rack at the back. Would it be Class 1 or Class 2?
 
I am happy for it to be in Class 1, it fits the criteria:

Class 1: SuperStock/Mild Custom, only minor frame changes are allowed (tidying the top of a seat pole, removing a brake bridge, that kind of thing.) but anything that bolts on, including forks, can be modified as much as you want.

As far as I am concerned what you are doing is tidying your seat pole and removing a rack is a pretty standard practice for any bike, not your fault they welded on instead of bolting...

If you want to go further you can of course, but that would put you into Class 2... ;)
